Gasoline leaking past gas cap

My month-old 2002 Savage has an annoying gasoline leak at the gas cap. Today I learned it was too easy to overfill the tank. I had filled it until the level was near the bottom of the filler neck while the bike was on the side stand, and when I picked up the bike with the cap in place, I heard air being sucked through one of the vent holes just as gas was pulled through the other hole and spilled all over the tank. It happened again even when I fitted the cap while holding the bike upright. That, however, isn't the big problem.

A similar problem seems to occur even when the tank is nearly empty. Just before that incident, when I left the office at lunch time to buy the gasoline (knowing I had ridden 108 miles since the last fill-up), I found gasoline streaking down the tank from the gas cap. I've observed the same symptom intermittently since I got the bike just before Christmas.

Is this a warranty item? I'm reasonably mechanically inclined but hate being patronized by mechanics--they're likely to tell me it's normal or I'm over-filling the tank.
